Notification on harmonization of General Terms and Conditions with the Law on Payment Services and the Law on Protection of Financial Services Users
We would like to inform you that Banca Intesa has harmonised the relevant General Terms and Conditions with the amendments to the Law on Payment Services. The rights, obligations and responsibilities of the Bank and the User in the event of an unauthorised, failed and incorrectly executed payment transaction and in the event of a delay in the execution of the payment transaction are defined. The provisions on how the framework agreement can be amended at the bank's proposal have been harmonised and the possibility of cancelling the spending limit for a payment card or for electronic/mobile banking applications has been introduced. These changes will apply from 06/05/2025.
The amendments also enable the use of new services such as confirmation of availability of funds, payment initiation services and account information services, in addition to harmonisation in the area of mandatory application of reliable user authentication; these provisions will apply from 01/01/2026.
In accordance with the time of receipt of the payment orders, the Term Plan has also been changed.
The corresponding general terms and conditions have been harmonised with the new Law on the protection of users of financial services, which relate to users – natural persons, registered agricultural businesses and entrepreneurs. The method of advertising financial services and providing information to the User has been specified. The provisions on the way in which amendments can be made to the contract and the procedure in the event of an unauthorised overdraft have been amended, the time limit within which the beneficiary has the right to lodge a complaint with the bank and the time limit for the bank's response have been set. These changes will apply from 01/07/2025.
